UFLPA Entity List Update – US Restricts Imports from China Made with Forced Labor

By: Joe Corbisiero on October 31st, 2023

The United States restricted imports from three more Chinese companies as part of an effort to eliminate goods made with the forced labor of Uyghur minorities.

Effective September 27, 2023, goods produced by the following companies are being restricted from entering the United States:

  • Xinjiang Tianmian Foundation Textile Co Ltd,
  • Xinjiang Tianshan Wool Textile Co. Ltd
  • Xinjiang Zhongtai Group Co. Ltd

Adding these 3 companies to the Uyghur Forced Labor Prevention Act Entity List brings the total number of entities on the list to 27.

The UFLPA, signed into law by President Joe Biden in December 2021, prohibits goods from being imported into the United States that are either produced in Xinjiang or by entities identified on the UFLPA Entity List, unless the Commissioner of U.S. Customs and Border Protection (CBP) determines, by clear and convincing evidence, that the goods were not produced with forced labor. CBP began enforcing the UFLPA in June 2022. Since then, CBP has reviewed more than 5,000 shipments valued at more than $1.74 billion under the UFLPA.

Why Should Businesses Stay Updated on the UFLPA Entity List?

By monitoring the UFLPA Entity List, businesses can protect themselves from the legal, financial, and reputational risks associated with importing goods produced with forced labor. If businesses do not have visibility into their supply chain, they risk their imports being stopped at U.S. ports and potential fines. The U.S. Customs and Border Protection recommends that businesses “[map] the supply chain and [assess] forced labor risks along the supply chain from raw materials to production of the imported good.”
