California Proposition 65, TSCA, FMD

SiliconExpert has put together several reports for the Top Searched Parts of 2022:

  • California Proposition 65
  • TSCA (Toxic Substances Control Act)
  • FMD (Full Material Declaration)

In the United States, compliance regulations can be determined at the federal level or on a state-by-state basis. At the federal level, the Toxic Substances Control Act (TSCA) is enforced by the Environmental Protection Agency (EPA) and lists all chemicals which can be legally manufactured, imported, and used for commercial purposes in the United States. All manufacturers and importers must provide the EPA with information on the use of chemicals in their products or commerce. Violations can result in fines up to $50,000 per day.

At the state level, California Proposition 65 (Cal Prop 65) was created to protect Californians from chemicals known to cause cancer, birth defects or other reproductive issues. Cal Prop 65 requires business to provide warnings to consumers about significant exposures to these chemicals. Penalties for violating Proposition 65 by failing to provide notices can be as high as $2,500 per violation per day. The list of chemicals included in Prop 65 is updated at least once a year.
